My token is a payment stablecoin. What should I do?

At a glance

Payment stablecoin

Payment stablecoins are covered by the GENIUS Act, which is already law (signed July 18, 2025). It takes effect by Jan 18, 2027 at the latest. A stablecoin from a permitted issuer is not a security (GENIUS Act Sec. 17).

Practical checklist

  1. Check the issuer's reserve reports. Once in force, permitted issuers must publish the monthly composition of their reserves (Sec. 4), have them examined by a registered public accounting firm, and have their CEO/CFO certify them each month.
  2. Check who the issuer is. Foreign issuers face extra conditions, so check each token's page.
  3. In the EU, some stablecoins (e.g. USDT) were restricted for EEA users under MiCA. See the delisting tracker.
  4. Keep good records. The IRS treats digital assets as property, so sales and swaps can be taxable whatever the token's legal status. IRS: Digital assets ↗
  5. Check where you hold it. Use the exchange safety checker to see an exchange's licences, enforcement history and reserves.
  6. Know your custody. Coins on an exchange aren't FDIC or SIPC insured. See the custody explainer.
  7. Follow it. Add the token to your watchlist and check Alerts. Statuses change when courts, regulators or Congress act.

What could change it

Final GENIUS Act rules from Treasury, the OCC and other regulators, or an issuer's licensing decision.
